1. DRIVER ELIGIBILITY – You agree and acknowledge that:
1.1 Only you and the listed authorized driver/s will drive the vehicle;
1.2 You must hold a valid current unrestricted motor vehicle driver's license for the particular class of vehicle hired. If you hold a foreign driver's license, it must be written in English or have a translation issued by a governing authority. Alternatively, an international driver's license/driving permit translated in English may also be presented.
1.3 Your foreign driver's license usage is only valid within 45 days upon arrival in the Philippines.
1.4 You have not within the three years prior to the Rental Period been convicted of an offense relating to driving a vehicle (a) under the influence of alcohol or drugs or (b) with a blood alcohol level over any legal limit.
1.5 You have not been refused nor had any motor vehicle insurance cancelled for any reason within 3 years prior to Rental Period.

2.1 You must only use the vehicle within the geographical boundaries of Central Luzon; the independent regions of Visayas and Mindanao
2.2 Inter-island transfers of vehicles are not allowed.  
2.3 The vehicle must NOT be driven on
a. Unsealed surfaces or roads;
b. Beaches or through dams, rivers or flood waters; any bodies of water;
c. Flood prone areas or any areas and roadways where any government agency has issued caution or warnings or has been considered impassable;
d. Mountain trails, rough terrain or any off-road paths

3.1 For any race, contest or performance test of any kind or to transport any commercial goods;
3.2 For any illegal purpose
3.3 For towing or pushing any object or other vehicle;
3.4 For subletting/hiring the vehicle and/or for carrying passengers for payment of any kind;
3.5 Carrying more passengers than may be properly accommodated by seat belts provided in the vehicle, or carry a greater load than that for which it was built;
3.6 When the driver is under the influence of alcohol or drugs
3.7 When it is damaged and/or unsafe;
3.8 To carry any flammable, explosive or corrosive substance;
3.9 To transport any animal inside the vehicle;
3.10 In breach of any legislation, regulations, rules or by-laws. Especially those related to road traffic.

4.1 You must:
a. Maintain all of the vehicle’s engine/brake oils/fluids and engine coolant levels to the manufacturer's specifications and ensure that the tires are maintained at the manufacturer's recommended pressure as provided in the vehicle manual. If there are warnings and/or you notice any irregularities (i.e. notifications on the dashboard, notification lights, warning sounds or differences vehicle’s drive and/or operation) please contact Europcar.
b. Keep the vehicle locked and the key/s under your personal control at all times. In the event of theft, you will be asked to produce the issued key/s;
c. Comply with any applicable seat belt & child restraint laws
d. Generally do all necessary to maintain the vehicle in its current state and condition (except for fair amounts of wear and tear).
4.2 You must NOT arrange or undertake any repairs or salvage to the vehicle (whether because of an accident or breakdown) without the express prior written authority of Europcar.
a. If repairs or salvage are necessary to prevent further damage to the vehicle or other property, you must first contact a Europcar representative by phone to inform them of the steps you are intending to take and obtain approval.
b. Europcar will only reimburse you for the cost of such authorized repairs or salvage if you keep and produce the original receipts for parts and services.
c. If the repairs or replacement of parts are not up to par with the standards of Europcar Philippines, you will be charged for the cost to restore the vehicle to its original state.

5.1 You must return the vehicle to Europcar:
a. At the return location/ branch, on the date and the time as listed on the Rental Agreement.
b. In the same condition as it was at the start of the Rental Period.
5.2 If you return the vehicle to a location other than that shown on the RA, you must notify Europcar Personnel. Drop fees may apply. If a Drop Fee applies, you must pay it at the end of the Rental Period.
5.3 If you return the vehicle to any place other than a Europcar location, or the Europcar location is not open on that day, or if the vehicle is returned outside the hours of operation, you will be deemed to have returned the vehicle to Europcar only when Europcar takes possession of the vehicle. (Please obtain the hours of operation from our website or counter staff).
5.4 Europcar may request the immediate return of the vehicle if you have breached or Europcar reasonably suspects you have breached the terms of this Rental Agreement. Europcar may repossess the vehicle without any notice to you. You must also pay Europcar any cost it incurs in the repossession of the vehicle as well as all reasonable costs and charges under the Rental Agreement.
5.5 Europcar reserves the right to not replace the vehicle if the vehicle, its parts or third party property is damaged during rental period.

6. FUEL – If you return the vehicle with less fuel than it had when you rented it, you must pay the cost of fuel and a refueling fee. The fee is subject to change due to fluctuation in fuel costs.

References to the "Vehicle" include all of its parts, components and accessories.
7.1 Damages are counted per occurrence and
7.2 Protection Packages must be purchased at the start of the RA.
7.2 In the event of an accident or damage, it is your responsibility to immediately inform personnel of Europcar Philippines and to obtain a police report (when another vehicle or person is involved) or an affidavit (when there is damage to property or stationary objects). If one is not provided, you shall pay for the full extent of the damages.
7.3 In instances where the estimated damage costs more than PHP 5,000.00 and you cannot produce a police report or affidavit is required for the damages or accident. Protection packages purchased at the beginning of the rental may no longer be applicable for the rental.
7.4 Except to the extent Europcar is liable by law, you are liable for:
a. The loss of, and all damage to, the vehicle
b. The cost of towing, recovering and storing the vehicle
c. For all damage to your property or the property of any person:
i. Which is caused or contributed to by you
ii. Which arises from the use of the vehicle by you
d. Appraisal or assessment fees
e. Reasonable administrative fees and legal costs of recovery
f. A per day loss of use based on 75% of the daily rental rate as displayed in the RA on the downtime of the vehicle calculated after the vehicle is returned.
7.5 If you accept Protection Packages on your RA at the start of the Rental Period (or it is included in your rate), you will pay the Damage Liability Fee for each separate event involving damage to or loss of the vehicle or the property of any third party which is caused by the use of the vehicle by you or an authorized driver, Europcar will reduce your liability for damage to the vehicle.
7.6 Protection Packages are applicable to any authorized driver complying with the terms and conditions of the RA. They are deemed void if evidence shows that the driver at the time of collision, damage or loss of the vehicle or any of its parts is not listed in the RA at the time of commencement.
7.7 If Protection Packages are not purchased or have been deemed as void, you must pay for the following:
a. The Damage Liability Fee if there is damage or loss of the vehicle or if there is damage to the property of any third party
b. The cost of rectifying any tire punctures
c. The cost of repairing any damage caused deliberately, carelessly or recklessly by: (I) you, (ii) any other driver of the vehicle or (iii) any passenger carried during the Rental Period;
d. The cost of repairing any damage to the vehicle or to third party property caused or contributed to by a breach of the RA
e. The cost of repairing any water damage caused by immersion of the vehicle in water, including whilst the vehicle is being transported
f. The cost of repairing any damage to the vehicle or to any third party property caused or contributed by you where you leave the scene of the incident or collision prior to the attendance of the Police or prior to you or your immediate and formal reporting of the incident or collision to the Police
g. The full cost of replacing or repairing all contents supplied by Europcar

8.1 Except as provided at law, Europcar is not liable to indemnify you or any person, for any loss of, or damage to, any property when:
a. Stolen from the vehicle or otherwise lost or damaged during the Rental Period
b. Left in the vehicle after its return to Europcar.
8.2 Europcar shall not be responsible for the state and condition of any property found in the vehicle after the vehicle’s return to Europcar. Any person claiming the return of such property is required to furnish Europcar satisfactory proof of ownership.

9.1 Where the use of the vehicle by you or any other person results in an accident or claim, or where damage or loss is sustained to the vehicle or any third party property or if the vehicle has been stolen, you and/or any authorized driver must:
a. Promptly report such incident to the local police
b. Promptly report such incident in writing to Europcar by satisfactorily and accurately completing the applicable forms for internal and external purposes and claims
c. Not make or give any offer, promise of payment, settlement, waiver, release, indemnity or admission of liability
d. Permit Europcar or its insurers at its own cost to bring, defend, enforce or settle any legal proceedings against a third party
e. Complete and furnish to Europcar within a reasonable time any statement, information or assistance which Europcar or its insurer may reasonably require, including attending at a lawyers office and at Court to give evidence
f. Forward to Europcar any claims or correspondence from third party's within one (1) day of receipt.

10.1 Rates are subject to change without prior notice. Please check rental rates and foreign currency exchange in force.
10.2 Confirmed reservations and rates made through third parties may be lacking in description of included items, excluded items and terms and conditions. We will refer to the Europcar Reference Book to rectify issues in such cases.
10.3 You must pay the full amount of the estimated rental charges at the time of vehicle pick up and at the start of the Rental Period. Adding 40% deposit if paying in cash.
10.4 At the end of the Rental Period, you must pay Europcar on demand:
a. All charges payable under the Rental Agreements, less any deposits already paid
b. Any applicable processing fees (for International reservations)
c. Any penalties or fines that were incurred during the rental period, whether they are paid/payable by Europcar or any authorized drivers. Such as, but not limited to speeding, road/highway toll, parking and traffic penalties or fines. In addition to any penalty or fine, the Renter is must pay Europcar for any administration fees
d. Any amount for which you are liable to Europcar under the Rental Agreement, in respect of a breach of the Rental Agreement or for damage or loss to the vehicle or third party property.
10.5 The minimum charge you must pay for the rental of the vehicle is an amount equivalent to:
a. One day's rental at the "daily rate" shown on the RA multiplied by the number of day of the rental period.
b. All other agreed fees and taxes specified on the reservation/RA.
10.6 You authorize Europcar to charge all moneys payable to Europcar under the RA to your credit card or charge account for any extension of the original contracted Rental Period, or damage detected upon return of the vehicle. Any existing damage will be noted in the RA. If the vehicle is returned with any additional damage, Europcar will charge your credit card or charge account with the Damage Liability Fee shown on RA.
10.7   You must make payments for the rental when Europcar so designates including when making payments in advance or at any other time during the Rental Period.
10.8   Europcar will pay any refund due to you by such method as Europcar may reasonably choose.
10.9   If you do not pay all charges at the end of the Rental Period, you must pay interest on the outstanding balance form the end of the Rental Period to the date all charges are paid in full based on the prevailing standard bank bill rate
10.10 If currency conversion is required in relation to any payment, the prevailing foreign exchange rate at the date of the Rental Agreement or the date on which liability for the payment is incurred will be used.
10.11 Any refunds made to your credit cards may take up to 90 days to refund due to standard operating procedures of the accredited handling bank.

11.1 Europcar shall have the right to terminate the Rental Agreement and take immediate possession of the vehicle at any time if you or an Authorized Driver breaches these terms and conditions.
11.2 Breaches of this Rental Agreement will result in you paying for:
a. All costs to rectify the vehicle to its original condition or replacement of the vehicle
b. Loss of rental revenue to Europcar
c. Damage to third party property being your full responsibility
d. All costs for towing, storage and recovery of the vehicle.
11.3 You will be entitled to terminate this Rental Agreement if Europcar breaches its terms and conditions.

12.1 The laws of the Republic of the Philippines govern these terms and conditions.
12.2 The information requested from you is to enable Europcar to assess your request to hire a vehicle from us. You do not have to supply this information. But if you do not, we may not be able to hire a vehicle to you, even if you may hold a confirmed or prepaid reservation.

13.1 If you believe that there has been an error in your account or if the amount charged is unreasonable you must notify the Branch Manager from where the vehicle was rented and submit within ten (10) working days your complaint in writing providing with exact details of your complaint together with any evidence in support of your complaint.
13.2 If Europcar concludes as a result of its investigation that:
a. Your account has been incorrectly debited, Europcar will respond by arranging to adjust your account by debiting your account and will notify you in writing or via email;
b. Your account has been correctly debited Europcar will respond by providing you with reasons and furnish you with any evidence for this finding.
13.3 If you are still dissatisfied and have further queries, you must notify us in writing within seven (7) working days and a meeting will be arranged as soon as practicably possible between you and representatives of Europcar in an attempt to resolve the dispute.
